We retain the absolute right to prevent you accessing the Website, without prejudice to any of our accrued rights, where we in our sole discretion consider that you are contravening our Acceptable Use Policy or any other aspect of these terms.
It's important to be transparent about our interaction with tools and how manufacturers may or may not allow us to retain tools that are delivered to us for review. According to the Guides Concerning the Use of Endorsements and Testimonials in Advertising (the "Guides") set forth by the Federal Trade Commission (FTC), by writing reviews, articles, or sharing our product opinions on social networks or through other types of media, our opinions may be considered an endorsement and we may be considered an endorser. As an endorser, we have an obligation under Guides (i) to let readers know if we received any free products or any other item of value from a manufacturer or if another material connection exists, and (ii) to ensure that our statements and reviews about manufacturers' products reflect our honest opinions, beliefs, and findings. We have to temper this, however, with the fact that we review literally HUNDREDS of tools per year and are not set up to manage the process and hassle of return shipping on every single tool. While it is our policy to return tools used in reviews, for the purposes of succinctly and efficiently fulfilling FTC guidelines, we have chosen to operate under the auspices (consumer assumption) that we actually retain all tools given to us by manufacturers - whether we do or not.
Let us make this clear. If all of our readers assume that we retain the tools, then we meet FTC guidelines and don't have to track whether or not we returned tools and notate that in each review - making each review have to contain a notation and impeding or muddying the actual review content. Because the government has seen fit to step in and make this process more complex, this is our method of meeting the requirements of the law without sacrificing the volume of reviews we can produce or having to open up a shipping department to manage and execute return tool shipments to manufacturers. Quite frankly, we'd rather allocate resources to reviewing more products for our readers.
Regardless of whether or not we retain a tool, we feel that, as professionals, our opinions are valid. Since our business model doesn't revolve around retaining tools or otherwise benefiting from products that we receive and render opinions on in the form of reviews, this is born out in our content and in-depth review consistency. Our business model is based on advertising revenue from banners and featured review placement, not reselling or hording tools. We have our own tools and can't get our work done without them. A good tool is still a good tool, and whether or not we retain a cordless drill or 2-foot level isn't going to change our opinions, or the trustworthiness of our articles.
Where the Website requires that you register in order to use it, you are obliged to provide accurate and complete registration information. It is your responsibility to update and maintain any changes to that information (including your e-mail address) by altering your details as appropriate.

We reserve the right to remove any information/material we deem to be in breach of any of these terms without notice, and without prejudice to any other accrued rights, and/or to make available such information/material when required to do so by law or when requested to do so by regulatory bodies or law enforcement organizations.
We take all such steps as are reasonably necessary to provide a fast and reliable service, but exclude to the fullest extent permitted by law any liability for the security of the services on the Website or for any disruption of the Website however caused, loss of or corruption of any material in transit, or loss of or corruption of material when downloaded onto any computer systems.

As this is a shared service with other users, you agree that if the demand for the services provided by the Website is in excess of our ability to meet the capacity, we may either share the capacity among all users or we may give you notice by e-mail that the provision of the Website will terminate. Any such termination will not affect your accrued liabilities incurred prior to any such termination.
Your dealings with any third parties, in particular advertisers and/or merchants, through the services provided by the Website and any terms, conditions, warranties or representations with such third parties are solely between you and such third party.
